Every month new competitive examinations and selection processes are announced in the Balearic Islands, organised by Town Councils, Island Councils, the Autonomous Community or other public sector entities.

Unfortunately, these processes do not always develop correctly. On the contrary, it is not uncommon for candidates to face situations in which transparency or equal opportunities are compromised, such as:

  • Unclear, contradictory or even unlawful rules of the call: poorly set deadlines, discriminatory requirements, illegal merit scales, or limitations without legal basis.
  • Poorly worded, ambiguous or off-topic questions that may mislead candidates and lead to arbitrary assessments by the examining board.
  • Incorrect official answers that unfairly alter candidates’ scores.
  • Errors in the evaluation of academic or professional merits, either by disregarding certain qualifications, accredited experience or duly approved courses, or by applying criteria different from those set in the call.
  • Unjustified exclusions of candidates, resulting from a restrictive interpretation of requirements, from remediable formal defects, or from discretionary decisions lacking legal grounds.

Faced with these issues, candidates have the right to defend themselves: they may challenge the rules, contest questions or answers, request a correct assessment of merits, or appeal the decisions of the Examining Board. This can be done through statements of objections, administrative appeals or, if necessary, a contentious-administrative appeal.
